1. Provider and scope
- The app “Song Peak” (the “App”) is offered by Morav IT UG (haftungsbeschränkt), Carl-Zeiss-Straße 8, 21465 Reinbek, Germany, represented by Yusuf Haidaryar (Managing Director), registered in the commercial register of the local court (Amtsgericht) Lübeck under HRB 27042 HL, email: info@morav-it.de (“Morav IT”, “we”).
- These Terms of Use govern your use of the App (“user”, “you”). Any terms of the user to the contrary do not apply.
- Apple’s terms (Apple Media Services) additionally apply to downloading the App and to in-app purchases. Payments are handled by Apple.
- Before you use the App for the first time, you confirm in the App with two separate tick boxes (a) that you have read and accept these Terms of Use and the Privacy Policy and (b) that you alone are responsible for voices you bring in, for publications and for similarities to other works, and that Morav IT is not liable for them (section 8). Without both confirmations the App cannot be used.
2. Service
- With the App you create a song with vocals, lyrics and cover art from a topic or your own text. Generation uses artificial intelligence (AI) running on your iPhone. Your inputs, lyrics, songs and cover art are stored on your device and are not transferred to Morav IT unless the Privacy Policy states otherwise.
- The App is available free of charge with ads and with the “Song Peak Plus” subscription, which unlocks additional features and turns off ads. The App shows which features belong to which tier before you subscribe.
- Some features require a supported iPhone, a current iOS version and Apple Intelligence. Without these, they are unavailable or limited.
- We continue to develop the App and may change features where this is reasonable for you and the core of the contractual service is preserved. Your statutory rights for digital products (sections 327 et seq. German Civil Code, BGB), in particular regarding updates, remain unaffected.
3. Requirements
- You must be at least 16 years old. Minors may use the App only with the consent of their parents or guardians.
- You use the App for yourself. The rights to your songs under section 5 also allow you to exploit them commercially.
4. Notes on AI
Songs, lyrics and cover art are generated automatically by AI. Results may be incorrect, inappropriate or unexpected. Morav IT does not review the results.
With AI-generated music it cannot be ruled out that a result resembles existing works (melodies, lyrics, voices, arrangements). Before publishing, check whether your song affects the rights of third parties.
Under Article 50 of Regulation (EU) 2024/1689 (AI Act), AI-generated audio, image and text content must, under certain conditions, be marked or disclosed as artificially generated. Morav IT marks content created with the App with the entry “AI-generated with Song Peak” in the metadata of exported audio and video files and with the label “AI-generated” in the App. If you publish a song that realistically imitates real persons, their voice or real events, you must disclose that it is artificially generated where the law or the platform’s rules require it.
Origin marking (Song Peak ID). The App creates a random identifier on your device once (“Song Peak ID”, for example SP-7K3M-Q9XA-2D4F). It is stored in every Song together with the creation time and App version and written into the metadata of every exported or shared file. It serves as proof that a Song was created with Song Peak and to defend against and pursue infringements. Details are in the Privacy Policy.
You may not remove, alter or obscure the AI marking or the origin marking (Song Peak ID, creation time, App version), including in copies, edits or compilations, as far as this is within your technical control. Conversion of a file by platforms that strip metadata on their own is not attributed to you.
5. Rights to your songs
- Your inputs (topics, texts, names) belong to you.
- To the extent that rights arise in the songs, lyrics and cover art created with the App (“Songs”) or Morav IT holds rights in them, Morav IT grants you the exclusive, transferable right, unlimited in time, territory and content, to use the Songs in all known ways, including commercially, in particular to reproduce, distribute, make publicly available, adapt them and to grant rights to third parties. You owe no remuneration for this.
- Content generated purely by AI may not be protected by copyright under current law. Morav IT does not warrant that any protective right exists in a Song or that it is free of third-party rights (see section 4.2).
- The App itself, its software, models, voices, design and trademarks remain the property of Morav IT or its licensors. You receive a simple, non-transferable right to use the App as intended for the term of the contract. License notices for third-party components are in the App under “Settings > Licenses”.
6. Rights needed to operate the App (operating licence)
- So that the App works, you grant Morav IT a simple, free, non-transferable right to process your inputs and Songs to the extent required to operate the App and the features you choose (for example storing, converting, backing up in your account once that feature exists, or handling a request you send us).
- Morav IT does not use your inputs and Songs for advertising, does not publish them and does not use them to train AI models unless you give separate consent.
- This right ends when you delete the content or the contract ends, unless a statutory retention obligation applies.
7. Prohibited content and uses
You may not use the App to create or distribute content that
- infringes personality rights, in particular insults, defames or exposes other people or violates their privacy, or uses names and personal details of third parties in a degrading way without their consent;
- records, uploads, imitates or uses another person’s voice without that person’s express consent, or copies or imitates the voice of well-known artists;
- infringes copyrights, neighbouring rights, trademarks or other rights of third parties, for example lyrics of others without permission;
- incites hatred, violence or discrimination, or is seditious, terrorist, extremist, pornographic, harmful to minors or otherwise unlawful, in particular sexualised depictions of minors;
- is intended to deceive about its artificial origin, for example to defraud others or manipulate public opinion.
You also may not remove or falsify the AI and origin marking (section 4.5), decompile or modify the App except as permitted by law (section 69e German Copyright Act), circumvent technical protection measures, ads or subscription checks, or use the App in an automated or mass manner.
8. Voices you bring in, similarities, publication: your responsibility and indemnity
- Principle. You alone decide which voices and content you bring into the App and whether, where and how you publish or exploit a Song. The following circumstances therefore lie within your sphere of responsibility and, as between you and Morav IT, are attributable to you alone.
- Voices you bring in. If you bring voices into the App, for example through your own or other people’s recordings or by uploading files, you alone are responsible for being entitled to do so. You warrant that you hold all necessary rights and consents, in particular
- the copyrights and neighbouring rights in the recording (for example of performing artists and phonogram producers, sections 73 et seq. and 85 German Copyright Act),
- the consent of every person whose voice can be heard in the recording or is to be imitated (general right of personality, right to one’s own voice and spoken word), and
- for minors, the consent of their parents or guardians. Copies or imitations of another person’s voice, in particular of well-known singers, are attributable to you. Morav IT does not review voices brought in and cannot tell whose voice you bring in.
- Similarities to works and voices of artists. Songs are generated automatically by AI. Morav IT does not owe that a Song resembles no existing work (melody, lyrics, arrangement, recording) and no artist’s voice (sections 4.2, 5.3 and 10). You check yourself before any publication or exploitation whether a Song resembles or copies such a work or voice. This applies in particular if you bring about the similarity through your inputs, for example names of artists, lyrics of others or voices you bring in. If you publish or exploit a Song, any similarity is attributable to you.
- Publication and exploitation, GEMA and other collecting societies. You alone are responsible for sharing, publishing and any exploitation of your Songs (for example on social networks, music and streaming platforms, at events, in broadcasting, in advertising, through sales or via a music distributor); you act at your own risk. Claims of GEMA and other domestic and foreign collecting societies and of all other rights holders arising from your publication or exploitation, in particular licence, remuneration, injunction and damages claims, concern you and are attributable to you. Morav IT does not acquire licences from collecting societies for your publications and does not pay any remuneration. If you register a Song with a collecting society, platform or distributor, you are responsible for the accuracy of your information, in particular regarding generation by AI.
- No liability of Morav IT for these circumstances. Morav IT has no influence on voices brought in or on your selection, publication and exploitation, and does not adopt your publications as its own. Morav IT is not liable to you for damage and disadvantages arising to you from the circumstances in paragraphs 2 to 4, in particular not for third-party claims against you. Sections 11.1 and 11.2 remain unaffected: Morav IT’s liability for intent and gross negligence, for injury to life, body or health, under the Product Liability Act, under a guarantee, for fraudulently concealed defects and for breach of essential contractual obligations is neither excluded nor limited by this section. Section 14.4 concerns only the App itself, not your Songs and the content you bring in.
- Indemnity. If third parties (for example rights holders, artists, collecting societies, platforms or persons whose voice was used) assert claims against Morav IT because of a circumstance under paragraphs 2 to 4 or because of a breach of section 7, you indemnify Morav IT against these claims to the extent you are responsible for the underlying infringement. The indemnity also covers the reasonable costs of legal action and defence, in particular court costs and lawyers’ fees at the statutory rates. Further claims of Morav IT remain unaffected.
- Cooperation. Morav IT informs you of such claims without delay, gives you the opportunity to comment and does not acknowledge them without consulting you, as far as reasonable. You support Morav IT in its defence promptly, completely and truthfully with the information and documents available to you, in particular with evidence of rights and consents under paragraph 2.
9. Subscription, ads and withdrawal
- You buy Song Peak Plus as a subscription via Apple’s in-app purchase. The App shows the price, term and any free trial before purchase; the price is charged to your Apple Account.
- The subscription renews automatically for the chosen term unless you cancel it in your Apple Account settings at least 24 hours before the end of the current period. A free trial converts into the paid subscription unless cancelled.
- Purchase, payment, cancellation and refunds are handled by Apple. You can restore purchases in the App under “Settings > Restore Purchases”.
- Right of withdrawal: As a consumer in the EU you have a statutory 14-day right of withdrawal for App Store purchases under Apple’s terms. You exercise it with Apple, for example at reportaproblem.apple.com.
- Ads: In the free tier the App shows ads from Google AdMob. Whether ads may be tailored to you is your decision in the consent prompt; you can change it in Settings. Details are in the Privacy Policy.
10. Defects
The statutory rights for defects of digital products apply. The App generates content by AI; the fact that a result does not match your taste or expectation or resembles existing works (section 4) is not in itself a defect.
11. Liability
- Morav IT is liable without limitation
- for intent and gross negligence,
- for damage arising from injury to life, body or health,
- under the German Product Liability Act (ProdHaftG),
- to the extent of any guarantee given and for fraudulently concealed defects.
- For slightly negligent breach of an essential contractual obligation, Morav IT is liable only for the typical damage foreseeable when the contract was concluded. Essential contractual obligations are those whose fulfilment makes proper performance of the contract possible in the first place and on whose compliance you may regularly rely.
- Otherwise, Morav IT’s liability for slight negligence is excluded to the extent permitted by law.
- For content you create with the App or bring into it, and for your publication and exploitation of it, section 8 applies in addition; there is no obligation to review user content. Paragraph 1 remains unaffected in any case.
- Your Songs are stored on your device. Back up important Songs yourself (for example with “Download”). In case of data loss, Morav IT is liable within paragraphs 1 to 3 only for the effort that would have been needed to restore the data had it been backed up regularly.
- These rules also apply to the personal liability of Morav IT’s employees, representatives and vicarious agents.
12. Term and termination
- The contract for the free App runs for an indefinite period. You can end it at any time by deleting the App. You cancel a subscription under section 9.
- Morav IT may terminate or discontinue the free tier with four weeks notice. Paid subscription periods remain unaffected. Both parties retain the right to terminate for good cause, for example in case of serious breaches of section 7.
13. Changes to these terms
If these terms or the Privacy Policy change in a way that requires your consent, the App shows you the new version before further use and asks for your consent again. If you do not agree, you cannot continue to use the App; you can cancel a running subscription under section 9. The previous version continues to apply until you agree.
14. Additional terms for use via the Apple App Store
- This agreement is concluded only between you and Morav IT, not with Apple Inc. or its subsidiaries (“Apple”). Morav IT alone is responsible for the App and its content.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Morav IT, not Apple, is responsible for any claims relating to the App (such as product liability, failure to meet legal requirements, consumer protection, privacy) and for third-party claims that the App infringes intellectual property rights.
- You represent that you are not located in a country subject to a US government embargo and are not listed on any US government list of prohibited or restricted parties.
- You comply with applicable third-party terms when using the App, such as those of your wireless carrier.
- Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.
- Please direct questions and complaints to Morav IT (contact details in section 1).
15. Governing law, jurisdiction and dispute resolution
- The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, you keep the protection of the mandatory provisions of that country.
- If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Morav IT’s registered office. For consumers the statutory places of jurisdiction apply.
- Morav IT is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
16. Final provisions
If any provision of these terms is invalid, the rest of the contract remains valid; the statutory provisions replace the invalid provision. This English version is for information; the German version prevails to the extent permitted by law.
Version 2, as of 13 October 2026.
